Tribal Loan Scams: How to Spot and Stop Them

The short answer: Real tribal lenders charge nothing before funding, name their tribe and lending LLC, publish state exclusions, and never guarantee approval. The scam patterns: upfront fees by gift card or wire, “guaranteed approval” with no underwriting, unnamed entities, jail threats on collection calls, and brands imitating real lenders’ names.

The fraud patterns

The eight checks

  1. Named tribe with state, and a named lending LLC — on the site and in the agreement.
  2. A published exclusion list or an explicit “ask us” policy, not silence.
  3. A tribal regulator or dispute body that answers (email it before applying).
  4. Full fee/APR disclosure in the agreement before you e-sign — TILA requires it.
  5. No fees before funding, by any method.
  6. A real domain history — check for years of archived pages, not a site born last month.
  7. Secure application (https, real privacy policy with an operator name and address).
  8. Cross-check the name in the CFPB complaint database and state AG consumer alerts.

If you already paid a scammer

Report same day: FTC (reportfraud.ftc.gov), CFPB, your state AG, IC3.gov for wire fraud, and your bank — gift-card and wire recovery windows are hours, not days. If you gave banking credentials or SSN, place bank-level blocks and a credit freeze (it is free at all three bureaus). A real lender can always be re-applied to; a scammer cannot be reclaimed.
